Un panel disciplinario ya había determinado que Tevez no debió haber jugado para West Ham. El equipo fue hallado culpable de trasgredir reglas de la Liga Premier al contratar a Tevez y su compatriota Javier Mascherano a una tercera parte, propietaria de sus contratos, en vez de hacerlo directamente con su club brasileño Corinthians. Enfrentado a un posible pago de 30 millones de libras (55 millones de dólares), West Ham dijo que apelaría ante el CAS, el máximo tribunal de arbitraje deportivo con sede en Lausana, Suiza. Pero el Secretario General del CAS, Matthieu Reeb, dijo el viernes que no oiría el caso a menos que Sheffield United estuviese de acuerdo. "Necesitamos el acuerdo de Sheffield United y las reglas de la Asociación del Futbol para permitir una apelación ante el CAS", dijo Reeb por correo electrónico. La suma de la compensación a Sheffield United será decidida por otro panel.
