CEVA Transport’s Ohio Employees Bring Collective Action to Enforce Federal Law and Seek Unpaid Ovecategory:Business and Professional posted:June 18th, 2009
On June 17, 2009, nine former employees of CEVA Transport filed a collective action under Federal Law for unpaid overtime compensation. Plaintiffs are represented by Stein Chapin & Associates LLC, a law firm specializing in complex litigation matters, including class and collective employment matters. Attorney David K. Stein stated, “CEVA maintained a policy requiring its employees to work overtime each and every week, but refused to pay them as provided by federal law.” CEVA is an international shipping management company with thousands of employees worldwide. In the U.S., CEVA employs hundreds of people who dispatch and coordinate shipping activities for CEVA’s cargo. “These people were required to work 10 or 12 hour days, but were paid as if they never worked overtime,” Stein said. CEVA recently closed its Ohio hub, but operates large hubs throughout the U.S. “It is possible that CEVA’s policy extended even beyond its Ohio operations, and that thousands of people across the country may have been denied proper compensation,” Stein said. The lawsuit, filed in U.S. District Court in Columbus, also alleges that CEVA did not maintain proper records of hours worked by its employees, as required by law. Plaintiffs seek to have their claims certified as a collective action under the Fair Labor Standards Act (FLSA), a type of class action in which individuals employed in similar job positions are provided with an opportunity to pursue overtime pay claims by opting into a lawsuit filed by representative plaintiffs. In order to participate in the FLSA lawsuit, employees who worked for CEVA during the past three years must file a FLSA consent to join form, which may be obtained from Stein Chapin & Associates LLC, counsel for the plaintiffs. Since filing the lawsuit, Stein reports that Stein Chapin & Associates has already been contacted by additional people who wish to join the case against CEVA. “It is possible that dozens or even hundreds of people who have worked for CEVA may have a right to join this case.” In representing the plaintiffs, Stein Chapin & Associates, LLC Attorney Stein stated, “Large employers continue to ignore the fact that their workers are entitled to overtime compensation for work performed b over forty hours per week.
