Cassidy, Hagerty, Colleagues Demand Answers from Biden Administration on Failure to File Court Documents for Illegal Immigrants

WASHINGTON – U.S. Senators Bill Cassidy, M.D. (R-LA), Bill Hagerty (R-TN), Marsha Blackburn (R-TN), Ted Cruz (R-TX), Mike Rounds (R-SD), and Cindy Hyde-Smith (R-MS) today sent a letter demanding answers on the Department of Homeland Security’s (DHS) failure to properly file tens of thousands of “Notice to Appear” (NTA) documents ahead of scheduled court hearings for illegal immigrants. This has resulted in the dismissal of more than 63,586 cases dealing with illegal immigration.  

“According to recently obtained data, tens of thousands of immigration court cases concerning the removal of illegal aliens were dismissed during Fiscal Year 2022 (FY 2022) because of failures by Department of Homeland Security (DHS) officials to properly file “Notice to Appear” (NTA) documents ahead of the scheduled court hearings,” wrote the senators. “Little information has been provided regarding why this mistake is occurring and how DHS will remedy it.”

“We urge you to immediately review DHS policies and practices relating to the issuance and filing of NTAs” continued the senators.
