Montgomery County Common Ownership Communities Program Goes into Effect July 1 in Gaithersburg

The Gaithersburg Mayor and City Council voted to opt into Montgomery County’s Office of Common Ownership Communities Program at its May 17, 2021 meeting. The adopted ordinance has a requirement for all common ownership communities in the City to participate in the program by July 1, 2022.

As defined by Montgomery County Code Chapter 10B, a common ownership community includes a development subject to a declaration enforced by a homeowners' association, as those terms are used in state law; a residential condominium, as that term is used in state law; and a cooperative housing project, as that term is used in state law. Learn more about what a common ownership community is by watching this video here.

The purpose of Montgomery County's Commission on Common Ownership Communities (CCOC) Program is to ensure proper creation and operation of homeowners’ associations, condominium associations, and cooperative housing corporations. The program also provides educational awareness to association members and board of directors, provides understanding of rights and responsibilities, resolves disputes, and regulates elections, budgets and enforcement in common ownership communities.

The CCOC program requires registration of associations and requires training for members of the governing bodies. All common ownership communities in the City of Gaithersburg are required to participate in the program by July 1.
